BY USING THIS SERVICE, YOU ACKNOWLEDGE AND AGREE THAT:
- YOU WAIVE ANY AND ALL RIGHTS TO CLAIMS, ACTIONS, OR PROCEEDINGS AGAINST TAILORED TEACHABLES, LLC, ITS OWNERS, OFFICERS, EMPLOYEES, AND AFFILIATES.
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
- THERE ARE NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- TAILORED TEACHABLES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.
- BY CONTINUING TO USE THIS SERVICE, YOU ACCEPT THESE TERMS IN FULL AND WITHOUT RESERVATION.
1. Acceptance of Terms
By accessing or using the Tailored Teachables SmartBoard Platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
Your continued use of the Service following any modifications to these Terms constitutes acceptance of those modifications.
2. Description of Service
Tailored Teachables provides an educational platform featuring learning management tools, interactive canvas features, assignment tracking, and related educational services. The Service is provided for educational purposes only.
3. User Accounts
To use the Service, you must create an account. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Providing accurate and complete information
- Notifying us immediately of any unauthorized use
4. Payment Terms
Student accounts require a one-time payment of $34.95 per student. Parent accounts are provided at no additional cost. All payments are processed securely through Stripe.
- All sales are final. No refunds will be provided.
- Prices are subject to change without notice.
- You are responsible for any applicable taxes.
5. Disclaimer of Warranties
No Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TAILORED TEACHABLES EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF CONTENT
- UNINTERRUPTED OR ERROR-FREE OPERATION
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TAILORED TEACHABLES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, use, goodwill, or other intangible losses
- Any damages resulting from unauthorized access to or use of our servers
- Any interruption or cessation of transmission to or from our Service
- Any bugs, viruses, or the like transmitted through our Service
- Any errors or omissions in any content
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.
7. Waiver of Claims
BY USING THIS SERVICE, YOU EXPRESSLY WAIVE AND RELEASE TAILORED TEACHABLES, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS' FEES) ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
8. Indemnification
You agree to indemnify, defend, and hold harmless Tailored Teachables and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Any content you submit or transmit through the Service
9. User Content
You retain ownership of content you create using the Service. However, by using the Service, you grant Tailored Teachables a non-exclusive, worldwide, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.
10. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.
12. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Florida, and the decision of the arbitrator shall be final and binding.
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
